Berry & Berry, PLLC, a law firm based in the Metropolitan Washington, D.C. suburb of Reston, Virginia, represents federal (CSRS, FERS), state*, private and public safety (police officers and firefighters) employees in their retirement matters before various federal and state agencies, as well as in matters involving private retirement plans and benefits.

Federal Employees

The Firm represents federal sector employees in all types of federal retirement issues. We represent federal employees in such matters as advising them about issues related to their eligibility for federal employee disability retirement from their federal agencies, in appeals or retirement-related matters before the Office of Personnel Management (OPM); in evaluating errors made by OPM in the course and scope of a federal employee’s retirement; as well as resolving a number of different types of legal issues that arise in the FERS and CSRS processes.

We often represent federal employees with respect to retirement errors through the Federal Erroneous Retirement Coverage Corrections Act (FERCCA), in appeals of retirement benefits before the Merit Systems Protection Board (MSPB) and in related survivor’s benefit / spousal retirement issues which relate to the federal employee retirement process. Many federal employees are unaware that Congress often adjusts the various federal retirement systems and that it can be difficult to qualify for certain types of retirement; therefore, we strongly advise any federal employee seeking to file even a standard CSRS or FERS retirement application to consider obtaining the advice of an attorney prior to starting the retirement process to avoid problems that may arise.

Law Enforcement/Firefighter Retirement Employees

As part of our practice, the Firm also represents and advises federal law enforcement officers (LEOs) and federal firefighters (FFs) on matters relating to their qualification and eligibility for this specific type of federal retirement program.

For state or District of Columbia law enforcement or firefighter employees, we represent and advise these individuals on the retirement and disability retirement processes that govern in their respective jurisdictions.

Private Sector Employees

The Firm also represents private sector employees in a multitude of general retirement law issues, ranging from general legal advice to representation on matters pertaining to their private company retirement benefits. In advising private sector employees, the Firm reviews employment-related policies, retirement pamphlets and manuals, as well as disability agreements which may affect the private sector employee’s retirement entitlement. There is a diverse range of retirement issues which can affect a private sector employee and the Firm’s goal is to provide them with solid legal advice and representation in these areas.
